An upheld decision means the ombudsman agreed with that consumer in that individual case. It does not by itself mean any other complaint will succeed, and every case turns on its own facts.

A word on names

The ombudsman publishes the name of the business a complaint was made against, but not its company number or FCA reference. Business names are not unique, so we have deliberately not attached company records or regulatory histories to this business that we could not verify beyond doubt as belonging to it. What to do if this sounds familiar

Where a business is still trading and regulated, a complaint starts with the business itself, which has up to eight weeks to give its final response. If that does not resolve matters you can take it to the Financial Ombudsman Service, which is free and independent, and this is how an IFX compensation claim would normally proceed, normally within six months of that response. Court action is the alternative, but it can be costly, and a claim above £10,000 carries the risk of paying the other side’s costs. If the business has stopped trading, the Financial Services Compensation Scheme becomes the route instead.
